Terms and Conditions of Sale



  1. Title to property described on the reverse side of this document shall remain in the name of East Bay Tire Co.until paid for in full, and that upon default, in payment, East Bay Tire Co. shall be entitled to take possession thereof without notice to the purchaser.
  2. Open Account: Payment terms are NET 10th Prox.
  3. C.O.D.: All C.O.D.’s will require either cash, cashier’s check, money order, Visa, or Master Card. Ask your salesperson for the total when placing the order so that you can have the correct amount ready upon arrival.
  4. Past Due Accounts: Accounts more than 15 days past due will be placed on C.O.D. until the balance is cleared. A charge of 1.5% will be placed on all accounts more than 15 days past due, and an additional 1.5% every 30 days until paid. This charge must be cleared before resumption of Open Account status. Should legal services be necessary to collect sums due thereunder, the buyer shall pay attorney fees and costs. If East Bay Tire Co. decides to file a claim against us with the Small Claims Court, we agree to have them file it in Solano County Small Claims Court
  5. Freight Policy: All freight is F.O.B. any East Bay Tire Co. warehouse unless arranged otherwise. All claims for lost shipments, shortages, or damages in transit must be filed with the carrier by the purchaser.
  6. Service Estimate / Work Authorization: I (we) hereby authorize the repair work to be done. You and your employees may operate equipment/vehicle for purposes of testing, inspection or delivery at my risk. An express mechanic’s lien is acknowledged on stated equipment/vehicle to secure the amount of repairs thereto. You are not to be held responsible for loss or damage to equipment/vehicle or articles left in equipment/vehicle in case of fire, theft, accident or any other cause beyond your control. I also acknowledge receipt of a copy of this work authorization and estimate of repairs.
  7. Returned Merchandise: Any and all merchandise returned must have a prior written “Returns Goods Authorization” (RGA) number, which can be obtained from East Bay Tire Co. sales staff. Any and all merchandise returned must be accompanied by a copy of the Pick Ticket or Invoice. Merchandise returned within 15 days from the date of purchase is subject to a 10% restocking charge. Merchandise returned between 16 and 30 days is subject to a 15% restocking charge. After 30 days, there will be a 20% restocking charge. There will be no returns on special order merchandise. All merchandise returned must be prepaid, no freight collect shipments will be accepted. There will be no returns after 90 days from date of purchase.
  8. Warranty and Adjustment Policy: Merchandise returned for adjustment must be accompanied by a completed RGA Adjustment Form, which can be obtained from East Bay Tire Co. sales staff. All new first tires and tubes (except aircraft tires for ground use, which are sold as is without guarantee) carry standard manufacturer’s warranty limited to defects in workmanship and material in accordance with industry practice. Tires returned for adjustment must be freight prepaid. Buyer understands that products included in this sale that are used or surplus stock are sold “as is.” All tires purchased as “NA” are non-adjustable. There are no excess or implied warranties regarding these products. Casings are guaranteed only as to recappability; warranty does not extend beyond the recapping process. There is a one year warranty on retreads and a 30-day warranty on all repairs.
  9. Credit memos can only be used toward a purchase from East Bay Tire Co. I (we) hereby agree to the above stated terms and conditions.
